Terms and Conditions for using Uber Organic Products and Services
The Uber Organic Website is provided to you free of charge for your personal use, subject to these Terms and Conditions. By using Uber Organic website and services you agree to be bound by these Terms and Conditions.
The Uber Organic Website is owned and operated by Uber Trading Limited
1. Delivery
a. All deliveries are despatched usually next day and within 2 days of placing. The delivery charges are listed on the delivery pages.
b. Before your order is to be dispatched, Uber Organic might contact you to make sure they are despatching to the correct address or that you are at the delivery address to receive your order.
c. Uber Organic will not be liable for any failed deliveries due to incorrect contact information whether that be telephone number or in the absence of that email or incorrect delivery address information.
d. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal.
e. If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss this causes. We will not, of course, charge for goods unless or until we have delivered them to you.
2. First Order Offer
This offer applies to all new customers that register on the Uber Organic website after the 27th of September 2007. The offer consists of £5.00 being deducted off the customer’s initial order value that includes one of our regularly delivered (repeat) boxes (see Organic Boxes). The offer can only be taken up by 1 person per household or specific delivery address. The offer will be void if Uber Organic Ltd has sufficient reason to believe that it has been misused by more than one registration on the same delivery address.
3. Cancellations
You can cancel your order anytime before we have despatched the order. After despatch you can still cancel your order by sending us the product in good unused condition. You will still be liable for shipping charges we may have incurred in sending the products to you
4. Replacement
It is our top priority to sell products of high manufacturing standards. On the odd occasion if you receive an items in a substandard condition we will send a replacement item free of charge.

6. Registration
To order from Uber Organic, you must register with us. This is referred to as set up an account or register throughout our website and literature. However, this is not a credit account, payment will be required upon delivery of goods.
Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the My Account area of the website..
7. Password and security
When you register to use the Uber Organic Website you will be asked to create a password. If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the Your Account area of the website.
If Uber Organic has reason to believe that there is likely to be a breach of security or misuse of the Uber Organic website, we may require you to change your password or we may suspend your account.
8. Payment
You must ensure that Uber Organic is provided with details of a valid credit or debit card bearing either the Mastercard, Visa, Delta, Maestro or Switch symbol. You must update your Uber Organic account in the “My Account” area with any change to these details immediately.
Your credit card and payment details will be held on our system; we do our best to ensure the security of these details but this cannot be guaranteed. Your card will automatically be charged for the goods which you have ordered, on or after the day of delivery.
9. Product purchases
Is this correct??? You may submit orders by using our online ordering facility at any time after you have created an account. The facility allows you to review your order and make any corrections before submitting it to us and by submitting the order you confirm that you have made any such corrections.
Your submission of an order amounts to an offer to enter a contract to buy the products from us; you cannot then withdraw or cancel your order except as stated below.
No order is accepted from you until we confirm this by electronic communication to you or by delivering the products. A contract for our sale of products to you arises on our acceptance of your order.
Where we accept an order, we do all that we can to ensure that your order is fulfilled; products are, however, subject to availability and market conditions and we do not always know if a product is or will be available at the time of accepting an order. If we are unable to deliver an item you have ordered, we will inform you of this and we will remove it from your order so that you are not charged or, if you have paid already, we will refund you the price. We will, however, bear no liability for unavailability of products.
All products offered by us are subject to occasional change in price. This is particularly likely with fruit and vegetable items which are subject to seasonal changes in supply levels and supply prices
Some of our products are priced by weight. The guide weight and associated price are for guidance only; the weight you receive may vary significantly from this guide and the price you are charged will be for the weight of product delivered.
Ordering a product from us carries with it the obligation to pay for it unless we receive from you a cancellation of or change to your orders before the deadlines published on the website and in our new customer letter sent as required there. We are also happy to inform you of these deadlines by telephone if you wish to call us. You remain responsible for ensuring that any such change or cancellation is not only transmitted by you, but received by us, in time for the deadline. We reserve the right to deliver and charge in full for any order unless we have received notice of cancellation before the published deadline.
10 .Licence for website access
Uber Organic grants you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Uber Organic. This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.
You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Uber Organic and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilising Uber Organic’s or its affiliates' names or trademarks without the express written consent of Uber Organic. Any unauthorised use terminates the permission or license granted by Uber Organic.
You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the Welcome page of Uber Organic as long as the link does not portray Uber Organic, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Uber Organic logo or other proprietary graphic or trademark as part of the link without our express written consent.
11. Availability of the website
Although Uber Organic aims to offer you the best service possible, we make no promise that our website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us (see below for contact details) and we will correct the fault as soon as we reasonably can.
Your access to the Uber Organic Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. In the event that our website is unavailable, our usual order and cancellation deadlines apply; please notify us of changes to your order via email or telephone
12. Your conduct
You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.
You understand that you, and not Uber Organic, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.
You must not use the website for any of the following:
• for fraudulent purposes, or in connection with a criminal offence or other unlawful activity
• to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam"
• to cause annoyance, inconvenience or needless anxiety
13. Electronic communications
When you visit Uber Organic or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
14. Uber Organic’s right to cancellation
Uber Organic may suspend or cancel any accepted order or your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. You can cancel your registration with us at any time by informing us in writing. If you do so, you must stop using Uber Organic services, including this website. The suspension or cancellation of your registration shall not affect either party's rights or liabilities accrued to the date of termination or any orders submitted by you before we received notice of your cancellation, and you will continue to be bound by such orders.
Any other provisions of these Terms and Conditions applicable to the use of the Uber Organic website shall survive cancellation.
15. Uber Organics liabilities
The ‘ Website is provided by Uber Organic as is without any warranties or guarantees save those set out in these Terms and Conditions.
Whilst Uber Organic tries to ensure that material included on the Uber Organic website is correct, reputable and of high quality, we cannot accept responsibility if, despite our endeavours, this is not the case. Without prejudice to your statutory rights, Uber Organic will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Uber Organic Website. If Uber Organic is informed of any inaccuracies in the material on the website, we will attempt to correct the inaccuracies as soon as we reasonably can.
We disclaim all liabilities in connection with the following:
(a) technical problems including errors or interruptions of the Uber Organic Website but we will use reasonable endeavours to correct or avoid them
(b) incompatibility of the Uber Organic Website with any of your equipment, software or telecommunications links
(c) unsuitability, unreliability or inaccuracy of the Uber Organic Website but we will take reasonable care to ensure information there is accurate
(d) inadequacy of the Uber Organic website to meet your requirements
15. Miscellaneous
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
We shall not be liable for any delay in or failure to perform any of our obligations if the delay or failure is caused by circumstances beyond our reasonable control including, without limit, difficulties or failures of our suppliers.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
16. Alteration of Service or Amendments to the Conditions
We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Uber Organic website. The changes will apply to the use of the Uber Organic Website after we have given notice. If you continue to use the Uber Organic website after the date on which the change comes into effect, your use of the Uber Organic website indicates your agreement to be bound by the new Terms and Conditions.
